Alcohol Laws in Holland

Weak alcohol (maximum 15%) can be sold to anyone over 16 yrs of age. Strong alcohol (more than 15%) sales only to persons over 18.

It is illegal to drive under the influence of alcohol and the maximum is 220 micrograms alcohol per liter in exhaled air. This is approximately the same as 0.5 in the blood. This means a driver cannot have more than two drinks before driving. This same rule goes for someone riding a bike, scooter, or motorcycle.

For drivers who have their license less than five years the law are even stricter and their blood level may not exceed 0,2, meaning one drink may be too many. This rule also applies to those who have a motorcycle license who are younger than 24 years of age.

It is against the law to be a nuisance or disturb others in public while under the influence.(TACTUS, Instelling voor Verslavingszorg)

  1. The law here, Spain, also has set 0.5 in blood as maximum alcohol contents. An anecdote is that despite the law a Judge here, the other day, overruled a fine imposed on a motorist whose alcohol-content in blood exceeded 2.3 because he deemed that amount did not affect his ability to drive.

Judges who so blatantly despise laws should be immediately suspended, but as the legal system goes the only way a defendant has here is just appeal to a higher Court. In this case the government should do so, but nevertheless the Judge should be punished accordingly.
